Do I need a UAE Will if I already have a Will in my home country? +
Yes. UAE courts do not automatically recognise or apply foreign Wills to assets held inside the UAE. A separately registered UAE Non-Muslim Will is required for your UAE-based assets — bank accounts, property, investments, business interests — to be protected and distributed according to your wishes.
What is covered by an ADJD Expatriate Will? +
Your ADJD Expatriate Will covers all assets held within the UAE: bank accounts and savings, real estate and property, investment portfolios, business shares and partnerships, vehicles, and personal assets. It also legally establishes your chosen guardian for any minor children. Additionally, it can include provisions for assets held internationally — overseas property, foreign bank accounts, pensions, and investments abroad. We review your full asset picture during your free consultation.
I am Muslim — do I still need a registered Will? +
Yes — and this surprises many Muslim residents. While Sharia inheritance principles automatically apply to the estates of Muslim residents in the UAE, a registered Wasiyya (Islamic Will) gives you something Sharia alone cannot: the ability to direct up to one-third of your estate — your discretionary third — to a cause, a charity, or a person who would not inherit under default Sharia rules. Without a registered Wasiyya, this right is permanently lost. A Wasiyya also clearly documents your wishes, significantly reduces the risk of family disputes, and ensures the ADJD has an official record of your intentions. We draft it in full accordance with Islamic law, in Arabic and English, and manage the entire ADJD registration process for you.
Does my spouse automatically inherit if I die in the UAE without a Will? +
Not automatically. Without a registered Non-Muslim Will, UAE Sharia succession principles may apply to your estate by default — regardless of your religion or nationality. This means the distribution of your assets may not align with what you or your spouse would expect or want. A registered Will protects your spouse and ensures your assets are distributed as you direct.
How long does it take to register a Will with Al Wissam? +
The typical timeframe from initial consultation to receiving your certified registered copy is 3–5 working days. The process involves an initial consultation, Will drafting and your review, and submission to the ADJD for registration. We handle all coordination and paperwork — you simply need to attend one appointment to review and sign your Will.
Can I update or change my Will after it is registered? +
Yes. A Will is a living document and can be updated whenever your circumstances change — for example, following the birth of a child, purchase of property, changes in your estate, or changes in your intended beneficiaries or guardians. We recommend reviewing your Will any time a significant life event occurs. Al Wissam can assist with amendments as needed.
Do I need a Will if I am renting and do not own property in the UAE? +
Yes. A Will is not only for property owners. It covers your bank accounts, savings, vehicles, business interests, investments, and — most critically — the legal guardianship of your minor children. Even without property ownership, a registered Will protects your family from frozen accounts, court-appointed guardians, and prolonged legal proceedings.
How long does the court registration appointment take, and can I speed it up? +
The notary appointment at the ADJD — the final step where your Will is officially registered — is subject to court availability. We coordinate this entirely on your behalf. Under the standard process this typically takes 3–10 working days depending on the court schedule at the time. If you need your Will completed urgently — for example, if you are travelling soon, have a medical concern, or simply want it done as quickly as possible — we offer a Fast Track option. For an additional AED 1,800 (a fee set and paid directly to the court), your notary appointment is prioritised and completed within 1 to 5 working days. We will advise you on the most suitable option during your free consultation.
Did you know? Your UAE Will can also cover your assets outside the UAE. +
Most expatriates do not realise this. A properly drafted Non-Muslim Will registered in the UAE can include provisions for assets held in other countries — savings accounts in your home country, overseas property, foreign investments, and international pensions. While the enforceability of UAE Will provisions varies by jurisdiction, having them clearly documented in a registered UAE Will significantly strengthens your family's legal position worldwide and gives executors a clear, authoritative starting point. During your consultation, we will review your full asset picture — UAE and international — and advise on the best structure to protect everything you have built, wherever in the world it is held.
